These Terms of Use and End User License Agreement (the “Terms”) are a binding agreement between you and Boot Dark Games, a brand operated by Cuality Corporation (“Boot Dark Games”, “we”, “us” or “our”), governing your use of the game Final Dash (the “Game”) on Android, iOS and Steam, and our website and online services (together, the “Services”).
By creating an account, downloading, accessing or using the Game, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
There is ZERO TOLERANCE for objectionable content or abusive behavior. Users who post offensive, harassing, hateful, illegal, sexually explicit, or abusive content — or who abuse other users — will have their content removed and their account suspended or permanently banned.
By using the Services or creating an account, you accept these Terms. You must be at least 13 years old (or the minimum age required in your country) to use the Game. If you are a minor, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms for it.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use the Game for your own personal, non-commercial entertainment on a device you own or control.

The Game and all related content, trademarks, artwork, music, code and other intellectual property are owned by Boot Dark Games / Cuality Corporation or our licensors and are protected by law. All rights not expressly granted to you are reserved.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us immediately of any unauthorized use. You may not share, sell or transfer your account, or create an account using another person’s identity.
The Game lets you create and share content such as custom levels, comments, direct messages, posts, usernames and profile information (“User Content”). You agree that you will not create, upload, post, send or display any content, or behave in any way, that:
This list is not exhaustive. We may determine, in our reasonable discretion, that content or behavior is objectionable and take action under Section 6.
You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate these Terms or any law or third-party right.
You retain ownership of your User Content. By submitting it, you grant Boot Dark Games a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt and distribute your User Content for the purpose of operating, providing and promoting the Services (for example, showing your level to other players or your comment on a level). This license ends when you or we delete the User Content, except for copies retained as required by law or already shared with others.
We do not endorse and are not responsible for User Content created by users. We may, but are not obligated to, pre-screen, monitor, edit or remove User Content at any time.

Our team reviews reports of objectionable content and abusive behavior and acts on them within a reasonable time — and we aim to review and act on reports of objectionable content within 24 hours. Depending on the severity, we may remove the content, issue a warning, suspend the account, or permanently ban the user. We may also remove content or take action proactively. Our enforcement decisions are made in our reasonable discretion and may be taken without prior notice.
The Game may offer optional in-app purchases and virtual items (such as diamonds, cosmetics or an ad-free option). All purchases are processed by the applicable platform (Google Play, the Apple App Store or Steam) and are subject to that platform’s terms. Virtual items have no real-world monetary value, are licensed (not sold) to you, and are non-transferable and non-refundable except as required by the platform or applicable law. We may modify, manage or discontinue virtual items at any time.
You may stop using the Services at any time and may permanently delete your account at www.bootdarkgames.com/delete-account/ or from within the Game.
We may suspend or terminate your account or access to the Services, remove your User Content, and take any other appropriate action, at any time and without prior notice, if you violate these Terms or if we reasonably believe your conduct may harm other users, third parties or us. Upon termination, the license granted to you ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability and governing law) will survive.
The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any User Content is accurate, appropriate or reliable. Your use of the Services is at your own risk, to the maximum extent permitted by law.
To the maximum extent permitted by law, Boot Dark Games / Cuality Corporation and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or related to your use of (or inability to use) the Services or any User Content. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve (12) months before the claim, or USD $25. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the Game or by email. Your continued use of the Services after the changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the United Mexican States (Mexico), without regard to its conflict-of-laws rules. To the extent permitted by law, you agree that the competent courts of Mexico will have jurisdiction over any dispute arising from these Terms or the Services. Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence.
